Court orders Ganduje to pay Magaji N5.7m

The National Industrial Court in Abuja has ordered Kano State Government to pay the suspended chairman of Kano State Public Complaints and Anti-Corruption Commission (PCACC), Muhuyi Magaji Rimin Gado the sum of N5,713,891.22.

The amount is, according to the court, Muhuyi’s salary arrears from the date of his suspension to the date of the judgement as the suspension of the claimant was not stated in the letter to go without pay.

The presiding judge, Justice Oyebiola O. Oyewumi, ruled out since the governor is yet to hand over the termination of appointment to the claimant he remains the substantive chairman of the state anti-graft agency, however, he cannot operate in that capacity due to his suspension.

Magaji asked the judge to declare his suspension illegal, void, and unenforceable, but the judge rejected his request and determined that doing so would interfere with the employer’s or appointer’s ability to restrict him by issuing an injunction against disciplining that employee or appointee.

The Governor who appointed the claimant has the authority to suspend him and may or may not give him a chance to be heard before doing so, the court ruled.

Magaji has been on the lam after refusing the anti-graft agency’s invitation over land racketeering.

The acting chairman of the commission, Mahmoud Balarabe revealed that Magaji was invited over allegations of carted away with crucial papers including information about investigations.

SAHELIAN TIMES had on January 2022 reported that the suspended chairman sued the state government for suspending him.

Magaji filed an application before the judicial division of National Industrial Court Abuja through his lawyers.

In the suit file the Kano State government is the first defendant while the Attorney General of Kano state, Kano State House of Assembly, Accountant General Kano State, Barrister Mahmud Balarabe, Kano State commissioner of police as 2nd,3rd,4th,5th, and 6th defendants respectively.
